These Terms of Service (the “Terms”) are a binding agreement between Comis d.o.o. (“Comis”, “we”, “us”, “our”) and you (“you”, “your”), and govern your use of the Menu Pixie mobile application (the “App”) and the menupixie.com website (together, the “Services”). By installing, opening or using the App, or by using the website, you agree to these Terms. If you do not agree, do not use the Services.

1. Parties & acceptance

The Services are operated by Comis d.o.o., a company registered in Slovenia at the address above. These Terms take effect the first time you use the Services and apply for as long as you use them. If you use the Services on behalf of someone else, you confirm you are authorised to accept these Terms for them.

2. The Service

Menu Pixie is an app that photographs restaurant menus, uses artificial intelligence to read and translate them, and renders a visual menu: dishes with photos, translated names and descriptions, prices, and automated dietary and calorie estimates. Certain actions in the App — such as scanning a menu — consume credits, which you can buy as in-app purchases (see section 5).

The App is anonymous by default: on first launch it receives an opaque Device Token, and no account exists until you choose to buy credits, at which point an account is created via Sign in with Apple or Sign in with Google. How we handle your data is described in our Privacy Policy (see section 9).

We may add, change or discontinue features of the Services over time, provided we do not in bad faith remove core functionality you have paid credits for.

3. Menu information is automated and may be wrong

This section is the most important one in these Terms. Please read it carefully.

  • Translations, dish names and descriptions, prices, ingredients, dietary suitability, allergen hints and calorie figures shown in the App are generated by AI from a photo of the menu. They are automated estimates and may be incomplete, outdated or simply wrong.
  • None of it is medical, dietary or safety advice. Never rely on it for allergy or dietary decisions — always confirm directly with the restaurant. The restaurant’s own menu and its staff are the only authoritative source of what a dish contains and what it costs.
  • Dish images are illustrative. AI-generated images are labeled as such and are illustrations, not the actual dish; photos from other diners or from stock sources may differ from what is actually served.
  • We are not affiliated with any restaurant, and we do not verify menus, prices or ingredients with restaurants.
  • To the maximum extent permitted by applicable law, Comis is not liable for decisions made in reliance on content shown in the App, including allergic reactions or other dietary outcomes.

4. Your content

You submit two kinds of content to the Services: menu photos you scan, and dish photos you upload.

Menu photos you scan. By scanning a menu, you submit its photo to the Services. You grant Comis a worldwide, non-exclusive, royalty-free licence to process, store and display that photo and the content derived from it — the parsed, translated menu — within the Services, including showing cached results to other diners and showing a menu to people you share it with via a share link. You confirm you are entitled to photograph and submit the menu.

Dish photos (“Plates”). The App lets you photograph a dish you were served and upload it (a “Plate”). Plates may be shown to other diners viewing the same dish at the same restaurant — that is their purpose, and your explicit consent to this sharing is captured at upload.

Plate licence. By uploading a Plate, you grant Comis a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, moderate, display and distribute that photo within the Services, including showing it to other users of the App. This licence ends for photos you delete, subject to reasonable caching and backup windows during which residual copies may persist before removal.

Your warranties. For every Plate you upload, you warrant that you took the photo or otherwise hold the rights needed to grant the licence above, and that it contains no unlawful content and no identifiable third parties without their consent.

Moderation. Every upload passes an automated moderation check before it is shown to others, and every served photo can be reported in-app; a reported photo is removed from serving immediately. We may remove, reject or decline to display any content at our discretion, including following moderation or reports, and removal is not an admission that the content was unlawful.

5. Credits & purchases

Credits are consumable in-app purchases made through Apple’s App Store or Google Play. Your purchase is also subject to Apple’s or Google’s own terms; they process the payment and handle any payment refunds under their policies — we never receive your card details.

Immediate delivery and withdrawal. Credits are digital content delivered immediately upon purchase. By purchasing, you expressly request immediate supply and acknowledge that your 14-day right of withdrawal lapses for digital content that has been consumed. Your statutory rights, including conformity rights for digital content under applicable EU law, are unaffected.

What credits are — and are not. Credits have no cash value, are non-transferable and cannot be exchanged for money. Credits do not currently expire; if that ever changes, we will give reasonable advance notice, and any change will apply prospectively. Your credit balance is maintained server-side against your Device Token or account — the balance shown in the App reflects the server’s ledger.

What credits are spent on. Credit-consuming actions include scanning a menu, adding more menu pages beyond the pages included with a scan, changing a menu’s language, saving a shared menu, and generating more dish images; what each action costs is shown in the App, and prices may change with prospective effect.

Failed actions are never charged. If a credit-consuming action fails — for example, a scan that does not complete — the credits for it are automatically refunded to your balance. You only pay for actions that succeed.

Promotional credits. We may grant promotional credits — such as starter credits for new installs or rewards for uploading dish photos — at our discretion. We may change or end promotional-credit programs at any time with prospective effect; changes never remove credits already properly granted to you (credits obtained through abuse of the Services are addressed under section 6).

6. Acceptable use

You agree not to, and not to permit anyone else to:

  • use the Services unlawfully, or in breach of these Terms or any applicable third-party terms;
  • scrape, harvest or systematically extract content or data from the Services, or access them by automated means other than the App itself or a standard web browser;
  • abuse rate limits, credit mechanics, promotional-credit programs or purchase flows, including by forging requests or manipulating device identity;
  • reverse engineer, decompile or disassemble the App or attempt to derive its source code, except to the limited extent that applicable law (for example, EU interoperability rules) expressly permits despite this restriction;
  • upload unlawful images or any content that violates section 4; or
  • interfere with the operation, security or integrity of the Services.

We may throttle, suspend or revoke Device Tokens and accounts, and restrict access to the Services, in response to abuse or breach of this section.

7. Intellectual property & feedback

The Services and all intellectual-property rights in them remain the exclusive property of Comis and its licensors. Except for the rights expressly granted in these Terms, no rights are transferred to you. Restaurant names, menus and trademarks belong to their respective owners and are shown for identification.

If you send us feedback, suggestions, feature requests, bug reports or other ideas — for example through our feedback board or by email — you grant Comis a perpetual, irrevocable, worldwide, royalty-free and transferable licence to use, modify and incorporate that feedback into the Services and our business for any purpose, without any obligation, attribution, confidentiality or compensation to you.

8. Third-party services

The Services interact with third parties we do not control: the restaurants whose menus you scan, Apple and Google (app distribution and payment), Google Places (restaurant identification), and third-party image sources. We are not responsible for their availability, accuracy or conduct. Menu Pixie is an independent product: we are not affiliated with, sponsored by or endorsed by any restaurant or any of these providers, and their trademarks are the property of their respective owners.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains what data we process and why — including that the App is anonymous by default and that your dish photos are shared only with your explicit consent.

10. Warranty & disclaimers

We provide the Services with reasonable skill and care, and will work to correct faults you report to support@menupixie.com without undue delay after you discover them.

Except as expressly stated in these Terms and to the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”, without further warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. In particular, and as section 3 explains, we do not warrant the accuracy, completeness or currency of any menu content, translation, price, dietary, allergen or calorie information, and we do not warrant that the Services will be uninterrupted or error-free. If you are a consumer, this section does not affect your mandatory statutory rights and guarantees (including conformity rights for digital content and digital services under applicable EU law), which continue to apply.

11. Limitation of liability

To the maximum extent permitted by applicable law, Comis, together with its owners, suppliers and licensors, will not be liable for any loss or damage arising out of or in connection with the Services or these Terms — including any indirect, incidental, special or consequential damage, or any loss of profits, business, data, goodwill or anticipated savings — whether based on contract, tort (including negligence) or any other legal theory, and whether or not we were advised of the possibility of such damage.

Nothing in these Terms excludes or limits our liability where the law does not allow it to be excluded or limited. The exclusion above therefore does not apply to: death or personal injury caused by our negligence; damage caused by our intent or gross negligence; liability under mandatory product-liability law; any guarantee we have expressly given; or any other liability that cannot lawfully be excluded. Where, in a case of slight negligence, we are liable for breach of an essential contractual obligation (one whose fulfilment is necessary to achieve the purpose of the contract and on which you may reasonably rely), our liability is limited to the foreseeable, contract-typical damage.

Subject to the foregoing and to the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Services and these Terms is limited to the amounts you actually paid Comis for credits in the 12 months before the claim arose (for users who have paid nothing, our liability is limited to the fullest extent the law permits). If you are a consumer, your mandatory statutory rights are not affected by this section.

12. Indemnity

To the extent permitted by law, you will indemnify and hold Comis harmless from third-party claims, damages and costs arising from your unlawful use of the Services, your breach of these Terms, or content you upload in violation of section 4 (for example, a photo you had no right to upload). This section does not apply to the extent a claim results from our own intentional or grossly negligent conduct, and, for consumers, applies only as far as permitted by mandatory law.

13. Termination

These Terms apply until terminated. We may suspend or terminate your access — including revoking Device Tokens and accounts — for material breach of these Terms or unlawful use. You can stop using the Services at any time, and you can delete your data and account as described in the Privacy Policy. Sections that by their nature should survive termination — including sections 3, 4 (for the period the licence continues), 7, 10, 11, 12, 15 and 16 — survive it.

14. Changes to the Services and these Terms

We may update the Services and these Terms from time to time. We will post the current version here with an updated “Last updated” date and, for material changes, provide reasonable notice (for example on the website or within the App). Your continued use after changes take effect constitutes acceptance; if you do not agree, stop using the Services.

15. Governing law & jurisdiction

These Terms are governed by the laws of the Republic of Slovenia, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The courts of Ljubljana, Slovenia have jurisdiction. If you are a consumer, you also enjoy the protection of the mandatory provisions of the law of your country of residence, and nothing here deprives you of the right to bring proceedings as permitted by those mandatory rules. The European Commission’s online dispute-resolution platform is available at ec.europa.eu/consumers/odr.

16. Miscellaneous & contact

These Terms, together with the Privacy Policy, are the entire agreement between you and Comis regarding the Services. If any provision is held invalid, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms in connection with a merger, acquisition or sale of assets; you may not assign them without our consent. We are not liable for delays or failures caused by events beyond our reasonable control. These Terms are written in English, which is the controlling language.
